1. Acceptance of Terms

By accessing or using the DigitalStacks platform ("Service") you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

DigitalStacks provides a managed digital presence platform for car dealerships, including live chat management, social media publishing, video ad creation, inventory management, and lead capture tools. Some features may use automation or AI systems to help generate responses, captions, content, and video assets.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for safeguarding your login credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to any part of the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Reproduce, duplicate, or resell any part of the Service without our written consent.

5. Customer Data and Data Protection

You are responsible for ensuring you have a lawful basis to upload, submit, or connect personal data to DigitalStacks, including customer leads, chat messages, dealership staff information, and vehicle listing data that may contain personal information. Where DigitalStacks processes personal data on your behalf, DigitalStacks acts as your processor and will process that data only to provide and secure the Service, comply with your lawful instructions, and meet legal obligations.

6. Data Processing Commitments

Where applicable data protection law applies, DigitalStacks will maintain appropriate technical and organizational measures, use suitable sub-processors, assist with reasonable data subject requests, and notify you of relevant security incidents as required by law. You authorize DigitalStacks to use sub-processors necessary to provide the Service, subject to appropriate contractual protections.

7. Content Ownership

You retain ownership of all content you provide (images, text, branding). By uploading content you grant DigitalStacks a limited licence to use it solely for providing the Service. Content generated by DigitalStacks on your behalf (posts, captions, video ads) is licensed to you for use on your channels.

8. Data Isolation

Each dealership workspace is fully isolated. Your data is never shared with or accessible by other customers.

9. AI-Generated Content

AI-generated responses, captions, posts, and video assets may require review before use. You are responsible for checking generated content for accuracy, legality, brand suitability, pricing accuracy, stock availability, finance claims, and compliance with advertising rules in your jurisdiction.

10. Service Availability

We aim for high uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.

11. Limitation of Liability

To the maximum extent permitted by law, DigitalStacks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

12. Termination

Either party may terminate the agreement at any time. Upon termination you may request export of your data within 30 days.

13. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or a notice on our website at least 14 days before they take effect.
